국제기자연맹(IFJ) 아시아·태평양지역 회원국(국장 재클린 파크)들은 23일 청와대에 특별 서한을 발송, YTN 사태의 원만한 해결과 해고자들에 대한 복직을 촉구했다.

아·태 회원국들은 이날 오전 9시 ‘아태지역 언론인들은 YTN 사태의 해결을 원한다’라는 제하의 공식 서한문을 청와대에 발송하고 “한국의 YTN 사측과 노조 사이에 빚어지고 있는 분쟁에 대해 우리들은 깊은 우려를 갖고 있으며 이명박 대통령이 이 문제에 관심을 기울이길 요청한다”고 밝혔다.

회원국들은 “노조와 직원들은 YTN이 경영과 독립적인 비판보도에 있어 YTN의 명성을 유지하는 등 회사가 성공적으로 기능하는 해결책을 소망하고 있다고 들었다”면서 “우리는 직원들의 우려의 근본적인 문제인 구본홍 사장 지명 건에 대해서 노조와 직원들의 입장과 함께 한다”고 말했다.

이들은 “한국기자협회(JAK)와 노조가 정부 측이 YTN에 대해 영향력을 행사, 혹은 시도하려 함에 있어 YTN이 귀중하게 여기는 ‘편집권 독립’이 취약해지지 않도록 담보함으로써 공공의 이익을 지키려 하고 있기 때문”이라고 설명했다.

이들은 이어 “방송통신위원회가 YTN의 사업권 재승인을 이번 달까지로 연기한 것은 언론자유와 편집권 독립을 지키기 위한 노조와 사원들의 조직적 저항 권리와 연계시키려는 게 아닌지 깊은 우려를 갖고 있다”고 지적했다.

또한 “YTN 사측이 직원들과 조직 대표자들의 우려감과 권리를 존중하고 이번 분쟁을 해소하기 위해 YTN 노조와 한국기자협회와 새로운 대화에 나설 것을 요청한다”면서 “노조도 대화에 나설 것을 권유한다. 국제기자연맹도 제3자 중재자로 지원하겠다”고 밝혔다.

서한에서 IFJ 아·태지역 회원국들은 조건없는 대화와 함께 6가지 합의안을 제시했다. 그들은 합의안에서 △노조 충성도 등에 관계없이 해고자 전원 복직 △모든 징계 철회 △편집권 독립을 위한 새로운 시스템 도입 △3개월 이상의 냉각기, 이해 당사자 간 공동 위원회 설립 등을 주장했다.

이들은 비슷한 내용의 서한을 YTN 사측과 노조에도 발송, 이번 사태가 빠른 시일 내로 매듭 되기를 바란다고 거듭 당부했다.

IFJ 아·태지역 회원국 각국 대표자 23명은 지난 12,13일 홍콩에서 열린 국제기자연맹 아시아 태평양 지역회의에 참석했으며 이 자리에서 YTN 직원들과 노조 대표, 연맹 회원 단체인 한국기자협회와 연대한다는 내용의 결의문을 만장일치로 승인한 바 있다.

Re: Asia-Pacific Journalists Seek YTN Resolution

Dear President Lee,

I am writing on behalf of the International Federation of Journalists (IFJ) and the leaders of journalists’ unions and associations across the Asia-Pacific region to draw your attention to our deep concerns regarding the ongoing dispute in the Republic of Korea between YTN management and media workers.

Leaders of 23 national and international union bodies attending a regional Asia-Pacific meeting of the IFJ in Hong Kong on February 12-13 unanimously endorsed a resolution to stand in solidarity with our colleagues at YTN, the media workers’ union and the Journalists’ Association of Korea (JAK), which is an affiliate of the IFJ.

As the dispute enters into its seventh month, we are informed that staff and their union representatives wish for a resolution which ensures YTN can operate successfully in line with good business practice and in keeping with YTN’s reputation for independent and critical reporting.

We therefore join staff at YTN in seeking to uphold the public interest by ensuring that YTN is not vulnerable to government influence or attempts to undermine its highly regarded editorial independence, which is the fundamental issue underlying staff concerns about the appointment of Mr Gu Bon-hong as YTN president.

The postponement by the Korean Communications Commission (KCC) of the renewal of YTN’s business licence until this month further raises our concerns about any efforts to link the network’s success and future to the right of staff to organise protests in defence of press freedom and editorial independence.

We call on your Government and YTN management to show good will and to negotiate fairly and openly with YTN staff to resolve this dispute in a manner that serves quality journalism and the best interests of the Korean public. In particular, we urge that management refrain from dismissals, disciplinary action, complaints to police and court injunctions.

In seeking to support YTN’s good standing, media freedom in South Korea and the right of workers to protest, we encourage YTN management to respect the concerns and rights of the staff and their nominated representatives and to make a commitment to enter into new talks with the YTN labour union and JAK in order to resolve the dispute. We will also encourage our union colleagues to support and participate in such talks. The IFJ is willing to assist as a third-party mediator if requested to do so.

These talks should prioritise securing guarantees for YTN’s editorial independence, ending all disciplinary actions against union members, and reinstating all employees dismissed as a result of their protest actions. We recommend the talks be held without preconditions but seek to agree on the following:

(i) Reinstating each and every workforce member dismissed during the dispute, regardless of their staff position or union allegiance. Reinstatement should be effective immediately.
(ii) Lifting all disciplinary penalties imposed against union members.
(iii) Ending all provocative actions including legal actions against individuals.
(iv) A joint declaration to guarantee and protect editorial independence at YTN and an agreement to establish new structures to maintain this protection.
(v) A cooling-off period (of not less than 3 months) and the establishment of a monitoring process . perhaps managed by a committee jointly established by the parties . to deal with any problems in the implementation of the settlement.
(vi) Both sides should consider jointly the appointment of a small arbitration group to deal with any problems of interpretation or difficulties arising from the agreement during the cooling-off period.

We urge you to seriously consider these recommendations, which arise from a visit by the IFJ’s General Secretary and a member of the IFJ Asia-Pacific steering committee to Korea in December 2008.

We call on the Government and YTN’s managers to respect the honourable motives of the YTN workforce and not to penalise them for defending their profession and democratic principles.

We also encourage the Government to recognise the concerns of journalists and media workers to defend independent media and urge that it make a public commitment stating its willingness to respect the editorial independence of journalism companies.

The future of YTN and its independence and professional integrity depend upon building public trust and the creation of a stable system of industrial relations and internal dialogue based upon mutual respect.

We look forward to your response and to informing other international press freedom organisations and our affiliate organisations, representing 600,000 journalists around the world, of a positive resolution to this dispute.

친애하는 이명박 대통령께,
저는 아시아 태평양 지역의 언론인 노조 및 언론인 협회 지도자들을 대표해서 한국의 YTN 사측과 노조 사이에 빚어지고 있는 분쟁과 관련해 우리의 깊은 우려감에 대한 대통령님의 관심을 요청하기 위해 편지를 쓰게 됐습니다.

지난 2월 12일부터 13일까지 홍콩에서 열린 국제기자연맹 아시아 태평양 지역 회의에 참석한 각국 대표자 그리고 국제 노조 기구 대표자 23명은 YTN의 동료들과 언론 노조 그리고 국제기자연맹 회원 단체인 한국 기자협회와 연대한다는 결의를 만장일치로 승인했습니다.

우리는 이 분쟁이 7개월째로 접어들고 있는 가운데 직원들과 노조 대표들은 YTN이 탁월한 사업 운영과 더불어 독립적이고 비판적인 보도 기능에 대한 YTN의 명성을 유지하는 등 회사가 성공적으로 기능할 수 있도록 담보하는 해결책을 소망하고 있다고 들었습니다.

따라서 우리는 구본홍씨가 YTN의 사장으로 지명 받은 것과 관련해 직원들의 우려감의 배경이 된 원천적인 문제로서 YTN이 귀중하게 여기는 편집권 독립을 저해하려는 정부의 영향력이나 시도에 취약해지지 않도록 담보함으로써 공공의 이익을 지키는 것을 추구하는 한국기자협회와 YTN 직원들과 입장을 함께 하는 바입니다.

또한 한국 방송통신위원회가 YTN의 사업권 재승인을 이번 달까지 연기한 것은 이 방송사의 성공이나 미래를 언론 자유와 편집권 독립을 지키기 위해 조직적으로 저항할 수 있는 직원들의 권리와 연계시키려는 노력이 아닌지 하는 우리의 우려감을 더욱 부추기고 있습니다.

우리는 당신의 정부와 YTN사측이 선의를 보여주고 또한 공정하고 공개적으로 YTN직원들과 협상함으로써 품격 있는 언론과 한국인 대중의 이익에 가장 부합하는 방식으로 분쟁을 해소하기를 요청합니다. 특히 우리는 사측이 해고나 징계조치, 경찰 고소 그리고 법원 가처분 등을 삼가기를 촉구합니다.

YTN의 훌륭한 위상과 한국의 언론 자유, 노동자의 저항권을 지지하기 위해 우리는 YTN사측이 직원들과 조직 대표자들의 우려감과 권리를 존중하고 또한 이 분쟁을 해소하기 위해 YTN노동조합과 한국기자협회와의 새로운 대화에 나서기를 요청합니다. 우리는 또한 우리의 노조 동료들도 그런 대화를 지지하고 참여하기를 권유할 것입니다. 국제기자연맹은 만약 요청을 받는다면 제3자 중재자로 지원하겠다는 의지를 갖고 있습니다.

이 대화는 YTN의 편집권 독립에 대한 보장을 확보하는 것과 노조원에 대한 모든 징계 조치를 종식시키는 것, 그리고 투쟁 과정에서 해고된 모든 직원들을 복직시키는 것을 최우선으로 삼아야 할 것입니다. 우리는 이 대화가 조건 없이 열려야 하지만 다음과 같은 합의를 추구하기를 권고합니다.

1. 분쟁과정에서 해고된 모든 직원들을 직원의 위상이나 노조에 대한 충성도 등과 상관없이 복직시키는 것. 복직은 즉각 효력을 발휘해야 한다.
2. 노조원에게 가해진 모든 징계를 취소한다.
3. 개인들에 대한 법적 조치를 포함해 모든 자극적 행위들을 종식시킨다.
4. YTN의 편집권 독립을 보호하고 보장하기 위한 공동 선언문 그리고 이러한 보호장치를 유지시킬 수 있는 새로운 구조를 설립하는데 합의.
5. 3개월 또는 그 이상의 냉각기와 점검절차 구축. 사태해결을 이행하는 과정에서 불거지는 문제점들을 다루기 위해 당사자들이 공동으로 설립한 위원회에 의해 운영될 수 있음.
6. 양측은 냉각기에 합의로부터 발생하는 해석의 문제나 어려움을 다루기 위해 소규모 중재단을 공동으로 구성하는 것을 고려해야만 한다.

우리는 지난 2008년 12월 국제기자연맹의 사무총장과 국제기자연맹 아시아 태평양 지역 운영위원의 한국 방문에서 제기된 이러한 권고를 심각하게 고려하기를 촉구합니다.

우리는 정부와 YTN사측 관계자들이 YTN노조원들의 존경스런 투쟁 동기를 존중하고 그들의 직업과 민주적 원칙을 방어한다는 이유로 벌칙을 주지 않을 것을 요청합니다.

우리는 또한 정부가 독립적 언론을 방어하기 위한 언론인들과 언론 종사자들의 우려감을 인식하는 것과 아울러 언론사의 편집권 독립을 존중하겠다는 의지를 표명하는 공개적인 약속을 내놓기를 권고합니다.

YTN의 미래와 독립, 직업적 고결성은 대중의 신뢰와 사업 측면의 안정적 체계의 창출, 상호 존중에 기반한 내부 대화에 의해 좌우됩니다.

우리는 대통령의 적극적인 조치와 함께 다른 국제 언론자유 조직이나 전세계적으로 60만 명의 언론인을 대표하는 국제기자연맹의 소속 단체에 대해 이번 분쟁이 긍정적으로 해결됐다는 소식을 알릴 수 있게 되기를 고대합니다.
